Unauthorized use of this Site and/or the materials contained on this Site may violate applicable copyright, trademark or other intellectual property laws or other laws.

Continued use of the Site will be subject to the successful authorization of all financial transactions and verification of all registered personal details and approval BY ANY Employee of Janlin.

Sleep Timers: On occasion Janlin will need to pause all auction activity for a brief period of time while our Internet Service Provider and/ or Host undertake essential and routine server maintenance and/ or necessary software updates.

We will endeavor to notify our customers, through the website, of any service interruptions and planned downtime to ensure that we are able to provide a seamless and stable service to our customers. In these rare circumstances all auction activity will be suspended for an advertised duration on the Home Page of Janlin.

Account Cancellation: The Site reserves the right to cancel your account for any reason whatsoever at any time without notice to you. Any balance in your account at the time of such cancellation will be credited to your credit card and/or sent to you by EFT. However,

According to the terms of use, the Site reserves the right, in its unfettered discretion, to void any winnings and confiscate any balance in your Janlin account in any of the following circumstances: 

1. If you have more than one active account at Janlin.

2. If the name on your  Janlin  account does not match the name on the credit card(s) used to make purchases on your  Janlin  account;

3. If you provide incorrect or misleading registration information;

4. If you have allowed or permitted (intentionally or unintentionally) someone else to use your  Janlin  account;

5. If you have not participated at the Janlin Auctions on an individual basis for personal entertainment only (that is, you have played in a professional sense or in concert with other bidder(s) as part of a syndicate club, group, etc.);

6. If you have “charged back” any of the purchases made with your credit card or any other purchase method whatsoever on your  Janlin  account;

7. If you are found cheating or if it is determined by  Janlin  that you have employed or made use of a system (including machines, computers, software or other automated systems) designed specifically to defeat the auction; OR

If Janlin should become aware that you have participated at any other on-line auction site under any of the circumstances set out at 1 to 7 above.

If you are identified as an underage individual. We adheres to a strict under 18 policy which does not permit auction participants under the age of 18 to participate in Janlin Auctions.

Multiple Accounts: According to the terms of use, all registered bidders on the Site are restricted to holding a single account. The use of multiple accounts by any registered Janlin member is strictly forbidden and is regarded as an unfair practice that is prejudicial to the performance and enjoyment of other bidders and, potentially, fraudulent.

We are obliged to verify the identity and domicile of Janlin account holders to protect both customers and Janlin: As such we can request proof of identity (copy of passport or ID) and proof of residence (a recent utility bill).

Janlin submits to regular independent audits of all user accounts and transactions and, in the event that a user is suspected of operating multiple accounts, Janlin reserves the right to suspend all of the related accounts pending further, detailed investigation by forensic computer specialists.

Should a breach of this condition be confirmed, Janlin further reserves the right to terminate all of the offending user’s accounts, to retain any unused credits and, at its discretion, to institute criminal proceedings against the offender.

Disclaimer of Warranty: The contents of this site are provided “as is” without warranty of any kind, either expressed or implied, including but not limited to warranties of merchant ability, fitness for a purpose and non-infringement.

The owner of this Site, the authors of these contents and in general anybody connected to this Site in any way, from now on collectively called “The Service Providers”, assume no responsibility for errors or omissions in these contents.

The Service Providers (SP) further do not warrant, guarantee or make any representation regarding the safety, reliability, accuracy, correctness or completeness of these contents.

The SP shall not be liable for any direct, indirect, general, special, incidental or consequential damages (including -without limitation- data loss, lost revenues and lost profit) which may result from the inability to use or the correct or incorrect use, abuse, or misuse of these contents, even if the Service Providers have been informed of the possibilities of such damages.

The Service Providers cannot assume any obligation or responsibility. The use of these contents is forbidden in those places where the law does not allow this disclaimer to take full effect.

Our Rights: We reserve the right to:

Modify or withdraw, temporarily or permanently, the Website (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or

Change these Conditions from time to time and your continued use of the Website (or any part of) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed.

If you do not agree to any change to the Conditions then you must immediately stop using the Website. We will make all reasonable effort to maintain the Website. The Website is subject to change from time to time.

You will not be eligible for any compensation because you cannot use any part of the Website or because of a failure, suspension or withdrawal of all or part of the Website due to circumstances beyond our control.

Verify personal information and financial transactions – purchases will only be shipped on completion of a positive identification and authorisation of all transactions on your Janlin account.

Auction items of R 10,000.00 and above will require an affidavit to be signed confirming that the auction item has indeed been received after having been paid for. Obtain photographs of the successful bidder in auctions and utilise the images for marketing and advertising.

Suspend and reopen an auction affected by an Autobid/ Bidbutler or system malfunction, specifically when an auction ends with active autobids still available in a participating users account.  Janlin reserves the right to cancel the auction or to reopen the auction at our discretion. 

Automated Notifications: Due to technical errors that may occur on an auction, the automated notifications sent are not a binding contract, including but not limited to notifications of securing an auction and 120% reached.

Janlin reserves the right to void any such automated notification and/or refund any monies paid and/or thereafter re-open the auction.

Janlin believes in creating a fair, fun experience for all bidders and if a user was prevented from bidding on an auction due to a technical error, Janlin will resolve the issue to ensure fairness across the board.

Software and Internet Access: The software used by the Janlin auction site has undergone stringent, third-party testing and was deemed to meet all of the required performance standards for an online auction.

We wish to point out however that access to the Site is provided by your specified ISP and influenced by the performance of your personal computer and Janlin accepts no responsibility for the quality or performance of either.

As a result of occasional bandwidth congestion experienced by a given ISP or excessive demands on your hardware resources from running too many programs simultaneously, the countdown reading displayed by the auction clock on your screen may not match the status of the countdown clock located on the auction server.

In all matters concerning the validity of a bid and the identification of a winner, an outcome are dependent entirely upon the server-based countdown clock and is thus consistent for all bidders.  

If a bid is placed during a live auction and the bid is accepted twice by the system at the same price increment, the auction will continue. This is not grounds for an auction to become void.  Janlin reserves the right to void any winnings that were obtained as a result of hardware/software error or malfunction.

Customers found abusing such errors/malfunctions are subject to having their account closed and any deposits and/or purchases forfeited. In the event of a Website system malfunction all auctions are void.

 Janlin will not be liable or responsible for any losses at auctions due to third party purchase processing due to a failure of the mechanism during an auction.

Gift Vouchers/ Meal Vouchers/  Complimentary ticket vouchers/Accommodation Vouchers: Secured at auction are subject to our terms of use and the retailer’s terms and conditions. Above vouchers secured at auction will be valid for 1 year from the date the auction closed. Above vouchers cannot be exchanged at for cash or converted to credits.

All payments must be made through one of the available payment options provided on the Site. Products/ Services purchased on a BUY NOW option may only be available in certain geographical locations and it is your responsibility to ensure you are able to access the products/ services in the specified location.

Winners will be liable for all eventual shipping fees if applicable.  Warranties on products/ services are provided by the suppliers and winners will need to contact the relevant supplier directly in the event of any claim.

When you have completed your order, you will need to contact support to complete the verification of your Janlin account before details of the seller will be passed onto you.

Redemption:  Once your Janlin account has been successfully verified, you will be provided with the Merchants contact details. Users will be responsible for contacting the Merchant directly to receive their product/ services purchased within the specified period, using the Invoice Date, Invoice Reference and Payment Reference number provided in your order confirmation e-mail.

 You may only redeem your BUY NOW deal order once and only after the Janlin Buy Now Deal auction has closed.  Any attempted redemption of a BUY NOW deal order not consistent with these terms and conditions,  may render a BUY NOW deal order void at our (or a Merchant’s) discretion.

Responsibility:  The Merchant and not  Janlin , is the seller of the product / services and solely responsible for providing you with the Product/ Services themselves., and for redeeming any BUY NOW deal you purchase within the specified period.

Restrictions: Reproduction, sale, resale or trade of a Janlin BUY NOW Deal order is prohibited. Any attempt to carry out any of these will void the Janlin BUY NOW Deal order. Janlin BUY NOW Deal orders is redeemable in their entirety only and may not be redeemed incrementally.

Combination: It is at the discretion of the Merchant to determine whether  Janlin  BUY NOW Deal orders can be combined with any other Janlin  BUY NOW deal order, or other promotions, vouchers, third party certificates or coupons.   Janlin  BUY NOW deal orders may not be applied to cover shipping or handling charges which may be incurred when the  Janlin  BUY NOW deal order is redeemed for a Product.

Loss / Theft: Janlin BUY NOW DEAL ORDER:  Neither we nor the Merchant are responsible for lost or theft of Janlin BUY NOW deals orders or the information contained within the e-mail received.

Expiry of Janlin BUY NOW DEALS ORDERS:  In respect of traditional Janlin BUY NOW deals orders- The Specified Period (including, but not limited to, any discounts provided by the Janlin BUY NOW deals order) expires on the date specified on the auction details.

In respect of Janlin BUY NOW deals orders which are redeemable for a ticket or admission to a specific ticketed event – Janlin BUY NOW deals orders shall have no value once the specific event date and time has passed.  

(i)  automatically if the event is canceled and not rescheduled, and

(ii) upon request if event is rescheduled.

 We have instituted this application procedure to minimize events of fraud.

Status of Janlin  BUY NOW DEALS ORDERS: All  Janlin  BUY NOW deals orders are promotional deals that are offered for Purchase below Deal Value and are subject to this Agreement and to any terms and conditions of the relevant Merchant.

Merchant terms: Merchants will have their own applicable terms of use and conditions, in relation to their own supply of their goods and services, and you agree to (and shall) abide by those terms and conditions. The responsibility to do so is yours alone.

Content on the website and Service: Janlin auction platform: It is your responsibility to ensure that any products, services or information available through the Website or the Service meet your specific requirements.

Product availability: All products or rooms are subject to availability.

Product Warranty (If applicable): The Standard Manufactures Warranty is provided with products ordered.

Delivery Policy (If applicable): Currently, all items purchased from The Site must be delivered by our/ the suppliers appointed carrier and will attract a delivery charge for your account, if delivered manually, and equal to the amount advised during the payment process.

When you click to make a payment with us, legal obligations arise and your right to refund of monies charged to your credit card or paid in any other way agreed by us will be limited by our terms & conditions.

You must not make any purchase through the site unless you understand and agree all our terms and conditions. Once payment is made for the purchase, it is deemed that you have read and understood the terms and conditions for such purchase.

Undelivered packages: Occasionally packages may be returned to us/ the supplier as undeliverable. Should this event occur, every attempt will be made to contact you to make arrangements for re-shipment. In the event of any additional charges incurred, you will be liable for such charges before re-delivery.

Order processing: All items been won by a register user will only become available within fourteen (14) working days.

Refunds/returns Policy: We have a no refund policy. All purchases are subjected to the seller T&C. Items purchased or won at Janlin cannot be exchanged or redeemed for a cash value.

Cancellation Policy:  Auctions that do not reach the reserve price required, will be canceled unless renewed by the seller. 

Payment Options and Pricing: The Site endeavors to offer you various payment options.

Travel Vouchers and Travel Deals: The purchase of a flight, trip, stay or travel voucher will result in acceptance by the customer of the Terms of Use of the issuing travel agency or business.

If the client needs to read the agency’s terms of service, Janlin will direct customers to the services of the travel agency or business. Guarantees and assurances assigned to the supply of travel are strictly governed by the Terms of use of Travel Agency or business. 

Social Media Applications: The site reserves the right to offer your listing on our social media platforms.

All of your order details will be saved online in the Your Account section available for use whenever you’re ready!

Questionnaires, Surveys and Profile Information: From time to time, we offer optional questionnaires and surveys to our users to gather demographic information or assessing users’ interests and needs.

The terms of use of the information collected is explained in detail in the survey itself. If in these questionnaires and surveys, we ask for personal information to our users, they are informed of the use that will be made even before taking the survey or the questionnaire.

Monitoring: We have the right, but not the obligation, to monitor any activity and content associated with the Website.

We may investigate any reported violation of these Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the Website).

Law: The Conditions will be exclusively governed by and construed in accordance with the laws of the Republic of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.

Updating of these Terms of use and Conditions: We reserve the right to change, modify, add to or remove from portions or the whole of these Terms of use and Conditions from time to time.

Changes to these Terms of use and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms of use and Conditions at the Website for changes or updates.

The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms of use and Conditions, including such changes or updates.

Consent: By using our website, you understand that all the designs and trademarks are registered to Janlin and you hereby accept the terms and conditions.

You undertake not to copy/duplicate the trademarks and designs directly or indirectly in anyway and understand the legal implications thereof.

Should you be found to be in violation of this agreement you will be held liable for all legal costs incurred by Janlin, for any civil action or any legal action deemed necessary against you.
